Now a company I worked for charged me with a jacknife wich never happened so now I am all that happened was a reported a quarter size dent in the truck. At any rate I am in the process of fighting this to get it off my DAC. I was wondering what kind of proof the company had to have tosubstantiate there claim. There was no citation of course because there was no jacknife there are no bills incurred because nothing happened . So is that the kind of proof they need to keep this on my dac.
the co did call me in for an accident review and I told them I didnt know when it happened that I was just reporting it so I didnt get in trouble for it.So does anyone know what kind of proof they must provide to USIS for this to be kept on there. Oh yeah they didnt even look at the truck when they called me in either. thanks for your help have a great day.

here, i must admit, you got me confused a bit.........let's start......with, 'a company you worked for".......does this mean you no longer work there....??

you are what....??? admitting to some damage...???

are you saying that you (later) admitted to putting a dent in the truck...??
so, let me try to dechyper what you were "trying to say"....
you put a dent in the truck, but didn't origianlly believe you did this, or you did know you did this, and "forgot" to report it.....
either way, to the company, you damaged the equipment, and a jacknife can be done while making a tight U-turn in a parking lot, of "jacking" your trailer into a position. so there are "other" jacknife's that can happen.

since we still do not know exactly how you were trying to explain yourself, i'll say this: its going to be tough. they (DAC) require NO PROOF of any accident. they are taking the trucking companies words for EVERYTHING. you really need to simply re-buttle the company's claim of what actually happened, and if you explain it to DAC the way you explained it here, they will not understand you either. you must carefully word the EXACT way it all happened.

yes, DAC don't care for proof. they take the company's word for it.

now, this gets tricky.........you didn't know when it happened.....do you share a truck with more than one other driver...?? can anyone jump into your truck if he needs a truck...??? if so, someone else reported the damage BEFORE HE STARTED his day, on the inspection report. EVEN IF the guy that wrote it up was IN FACT the one who damaged the truck, he covered his @ss by saying BEFORE his shift, he found damage....
if you didn't notice ANY NEW damage BEFORE you started like you're supposed to, you just got nailed, big time. you didn't cover your @ss with a proper pre-trip. and i might add, you should have done a proper POST trip as well..........if you did BOTH, you would have caught the damage yourself, and told someone sooner.
now, if the truck is yours, and ONLY YOU drive it, then who noticed the damage.....?? the shop...?? the yardman....?? the dispatcher doing the daily trailer/truck count...??? who....????

nope, as i said, DAC DON'T NEED PROOF...........someone failed to notice the damage....OR someone didn't properly report an incident, OR someone else did the damage, and since you didn't do a good pre-trip OR post trip, you got nailed....
so again, since i could not fully understand your thread, as it seemed convoluted in the explaination, i'm going on some assuptions right now. |

| I no longer work for the company. I quit about 5 months after this. I reported the dent immediatly upon discovery of it however I dont know what part of that day it happened in. I do not remember doing it however the tractor it self was parked on the street for several hours after I put the trailer into the door I had to disconect and then park the tracor on the street and go back to the dock and wait for the trailer to be unloaded. They only had one guy in there loading and unloading and he said he would not have time to come get me so I just waited in the wharehouse. After I reconected and pulled out I got out to shut the doors. I walked around the truck and trailer checking everything and something did not seem right to me so I walked around it a few more times and then saw the dent. I reported it immediatly then was called in for a review and told them the same thing I said here. The guy asked me why I bothered to report it and I said cause it is not my truck. Then he said that he should not put it on my record but he was going to now I found out it is a jacknife and have been told by several companies that they wont even look at me for 5 years. So I am just beside myself had I known what it meant when he said he was going to put it on my record I would not have walked away from that room. |

well the funny thing is I contacted the company once to ask them to take it off there and they rufused. However they are the only company willing to hire me now. So when talking to the recruter I asked what it said in the company file and she said that it said that I reported a dent so I am thinking with dacfix if they do what they say they do I can get it off there.
however in the meantime I am going to have to go back to work for that company as I have no other choices |

i appologize for getting back to you so late. i've been busy.....this being said, i don't believe you ever mentioned EXACTLY where the dent is...is it located at the "side wing" of the cab, or maybe its caled the "cab extenders"...?? if so, this is usually how they get damaged, by "jack-knifing" a trailer...
STAY AWAY fro DACFIX....i have NOT hear good things about them. in fact, check out our boards,as there IS a thread about them here someplace.
as far as going back and working for the same company that let you go, i wouldn't..........but that's just me.........i NEVER GO BACK.......i go FORWARD.........
i don't know what else to tell you on this one.
